1. Agreement to Terms

These Terms of Service (“Terms”) are an agreement between you and DM FollowUp (“DM FollowUp,” “we,” “us,” or “our”) regarding your access to and use of the DM FollowUp website, dashboard, browser helper, billing flows, and related services. DM FollowUp is operated from Türkiye.

By creating an account, using the Free Plan, purchasing a Business License, or using the service, you agree to these Terms. If you do not agree, do not use the service.

2. Service Description

DM FollowUp provides a customer follow-up assistant designed for small businesses that receive customer requests through Instagram DMs. Our service helps users save customer requests, add customer notes, use request labels/status tags, set follow-up dates, and prepare reply drafts, all managed through a central dashboard.

DM FollowUp provides tools to organize saved customer requests and follow-ups. It does not guarantee that customers will reply, purchase, book, or complete any transaction. You decide which customers to save, what notes to add, and when to reply. You remain solely responsible for the content, timing, and compliance of any communications or messages you send.

3. Independent Service and Instagram Disclaimer

DM FollowUp is an independent software service and browser helper. It is not affiliated with, sponsored by, endorsed by, or officially connected in any way with Meta Platforms, Inc., Instagram, or any of their affiliates or partners. Instagram and Meta are registered trademarks of their respective owners. DM FollowUp operates separately and independently of Instagram's official developer network.

4. Eligibility

By using DM FollowUp, you represent and warrant that you have the legal capacity to enter into a binding contract and that you are using the service solely for business, professional, or commercial purposes. If you are entering into this agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these Terms.

5. Account Registration and Security

To access and use DM FollowUp, you must register for an account by providing accurate, complete, and current information. You are responsible for keeping your DM FollowUp account credentials and browser helper access tokens secure.

Your DM FollowUp credentials are separate from Instagram. DM FollowUp does not require or collect your Instagram password. You are responsible for keeping your DM FollowUp login secure, and you are solely responsible for any and all activity that occurs under your DM FollowUp account.

6. Service Scope and Boundaries

DM FollowUp provides a web-based dashboard and a companion browser helper to assist you with organizing customer requests. These features include saving customer requests, customer notes/details, request labels, follow-up dates, reply drafts, and browser helper integration. DM FollowUp may help you prepare reply drafts, but you decide whether, when, and how to use them.

DM FollowUp does not require your Instagram password. DM FollowUp does not connect to your Instagram account through Meta OAuth, does not store Instagram access tokens, does not read your full Instagram DM inbox, and does not send Instagram messages on your behalf.

The browser helper is designed to make it faster to save customer details while you work on Instagram. It sends information to DM FollowUp only when you choose to save or update a customer request.

7. User Responsibilities

You are responsible for the customer information you choose to save. You are responsible for ensuring that you have a lawful basis to save and manage customer information in DM FollowUp, and for complying with any privacy, consent, consumer protection, marketing, and platform rules that apply to your business.

You must respect customer privacy, consent requirements, and local marketing/anti-spam regulations when communicating with customers. You are responsible for messages you choose to send and must follow all applicable local laws, regulations, and Instagram/Meta terms. You must keep customer information accurate where needed, and you must not use DM FollowUp for any unlawful, harmful, misleading, or abusive purposes.

8. Customer Data and Content

You retain all rights, title, and interest in and to the customer names, request notes, status labels, follow-up dates, and reply drafts you add to DM FollowUp. By entering this data, you grant us a limited, non-exclusive, worldwide license to host, transmit, and process it solely to the extent necessary to provide the service to you.

You must not upload or save sensitive personal data (such as health, financial, or government identification details) in DM FollowUp unless you have a clear, lawful reason to do so. You agree not to store any illegal, harmful, or infringing content.

9. Acceptable Use

You agree not to misuse DM FollowUp or assist anyone else in doing so. Specifically, you agree not to:

• Access, tamper with, or use non-public areas of the service, or accounts belonging to other users.
• Interfere with, disrupt, or attempt to compromise the security, integrity, or reliability of our servers or networks.
• Reverse engineer, decompile, or copy the underlying code, structure, or design of DM FollowUp.
• Use the service to support harassment, abuse, or the distribution of unsolicited marketing messages.
• Collect or store customer data unlawfully.
• Attempt to bypass, disable, or circumvent any service limits, security features, or usage restrictions.

10. Access, License Purchase, and Payments

DM FollowUp is offered as a Free Plan (limited to 10 saved customer requests total) and a Paid Business License (a one-time purchase of $49 for unlimited requests). There are no recurring subscription fees.

The Free Plan is provided to let you test DM FollowUp features. No payment details are required to use the Free Plan.

If you choose to upgrade to the Business License, payment is processed through our online reseller Paddle.com. Paddle.com is the Merchant of Record for our orders. Paddle handles checkout, payment processing, tax calculation, receipts, payment-related support, and refunds/returns.

Your purchase is also subject to Paddle’s buyer terms, refund policy, and privacy notice.

11. 14-Day Refund Guarantee

We offer a 14-day refund guarantee for the Business License purchase. If you are not satisfied with DM FollowUp within 14 days of your purchase, you can contact us at support@dmfollowup.com or through Paddle to request a full refund.

Upon refund approval, your workspace will be reverted to the Free Plan limits. If you have already saved more than 10 customer requests, you will still be able to view and export them, but you will not be able to save new requests until you purchase a license again.

12. License Limits and Fair Use

The Free Plan allows you to store up to 10 customer requests in total. The Business License provides unlimited request storage for one business.

DM FollowUp is designed for manual business operations. To protect the security, integrity, and performance of the service, we reserve the right to apply reasonable usage guidelines or contact you if your usage is unusually high, automated, or exhibits abusive patterns.

13. Refunded or Revoked Licenses

If your Business License is refunded or payment is charged back, your access will be reverted to the Free Plan. Your account will operate under the 10 saved requests limit.

14. Privacy

Your privacy is important to us. Our collection, use, and processing of your personal data and the customer information you save are governed by our Privacy Policy. By using DM FollowUp, you acknowledge and agree to the data practices described in that policy.

15. Third-Party Services

DM FollowUp relies on third-party service providers to function, including infrastructure hosting (Firebase/Google Cloud), user authentication, and email delivery.

We are responsible for providing the DM FollowUp service. Paddle is responsible for processing payment transactions as merchant of record. Paddle handles checkout, payment processing, tax calculation, receipts, one-time billing, and payment-related support. Paddle's own terms and privacy notices may apply to payment processing.

The service also operates in connection with Instagram/Meta platforms, which are used independently by you. We do not control these third-party platforms and are not responsible for their terms of service, policies, or changes to their systems.

16. Availability and Changes

We strive to keep DM FollowUp reliable and accessible. However, we may update, modify, temporarily interrupt, or discontinue features of the service at any time to perform maintenance, apply security updates, or improve the product.

17. Disclaimers

DM FollowUp is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we make no guarantees, warranties, or representations of any kind regarding the service. We do not guarantee increase in sales, customer replies, business conversion, or uninterrupted availability.

Because DM FollowUp operates alongside browser technologies and third-party web platforms, changes to browser extensions, operating systems, or Instagram's web structures may affect or temporarily limit features of DM FollowUp.

18. Limitation of Liability

To the maximum extent permitted by law, the operator of DM FollowUp, its affiliates, and its service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, or data, arising out of or relating to your use of or inability to use the service.

19. Indemnity

You agree to indemnify and hold harmless the operator of DM FollowUp and its affiliates from and against any third-party claims, liabilities, damages, or costs (including legal fees) arising from your misuse of the service, your violation of these Terms, your unlawful handling of customer information, or your violation of applicable laws or third-party terms.

20. Termination

We reserve the right to suspend or terminate your account and block access to the service immediately, without prior notice, if you breach these Terms, experience a payment failure, refund, or chargeback of purchase fees, engage in abusive or fraudulent conduct, or present a security risk to DM FollowUp or other users.

21. Governing Law

These Terms are governed by the laws of the Republic of Türkiye, unless mandatory consumer protection or data protection laws provide otherwise.

22. Changes to Terms

We may update these Terms from time to time to reflect regulatory changes or product updates. The "Last updated" date at the top of this page will indicate when the Terms were last revised. Your continued use of DM FollowUp after updates are posted constitutes your acceptance of the revised Terms.

24. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and DM FollowUp regarding your use of the service, superseding any prior agreements or understandings.
